12.06.2025
IN THE HIGH COURT AT CALCUTTA
Item No.29 CIRCUIT BENCH AT JALPAIGURI Ct.No.2 dc.
Rejected C.R.M. (A) 351 of 2025 In Re : An Application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Mal Police Station Case No. 34 of 2025 dated 22.01.2025 under Sections 118(1)/118(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
And In Re :
Adhir Matabbar and another ... Petitioners.
Mr. Anirban Banerjee ... For the Petitioners.
Mr. Ujjwal Luksom, Ms. Namrata Das ... For the State.
Learned advocate appearing for the petitioners submits that the petitioners are innocent of the charges and they have been falsely implicated in connection with the instant case and so far as the injuries which are complained of were not attributed at the behest of the present petitioners. As such, the petitioners may be favoured with an order of anticipatory bail.
Learned advocate appearing for the State produces the case diary and draws the attention of the Court to the injury report as also the statement of the injured.
I have considered the nature of the injuries which are grievous in nature and which may have resulted in disability of a vital organ of the body. Having considered the same, I
am not inclined to accede to the prayer advanced on behalf of the petitioners. As such, the prayer for anticipatory bail of the petitioners is rejected.
The application for anticipatory bail, being CRM (A) 351 of 2025, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
