APP Ms. Sukanya Adhikari ... for the State Learned advocate for the petitioner submits that the other co-accused has been enlarged on bail. Learned advocate further submits that FIR was instituted after 11 months, as such, the petitioner may be released on bail. Learned advocate for the State has produced the Case Diary and submitted the DNA report reflecting that the same has matched with the present petitioner and the next date has been fixed by the learned trial court for examination of the accused persons under Section 313 of the Cr.P.C.
Having considered the advanced stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail of the petitioner is Rejected.
However the Special Court would put in efforts so that after examination of the accused persons under section 313 of the Cr.P.C. verdict is pronounced within a period of three months.
Accordingly, CRM(M) 109 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
