Report submitted by the investigating officer of the case enclosing the order dated 16.06.2025 passed by the learned Additional Sessions Judge, 1st Court (NDPS), Cooch Behar, as also the report of inventory which was done by the learned Judicial Magistrate, Mathabhanga and which reflects that the seized contraband of 3941 pieces of YABA Tablets is weighing 400 grams, be kept with the record.

Considering the seizure which exceeds commercial quantity, I am of the view that the rigors of Section 37 of the

NDPS Act are attracted. As such, the prayer for bail of the petitioners is rejected at this stage.

Petitioners would be at liberty to renew their prayer after the evidences of CSW2, CSW3 and CSW4 are over. Accordingly, CRM (NDPS) 227 of 2025 is dismissed. Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners.
