The petitioner has preferred the present writ petition, being aggrieved by the inaction of the respondent authorities in failing to take appropriate steps to prevent unauthorized construction allegedly carried out at apartment No.B-11, Basundhara Abasan, Satellite Township, Dabgram, P.O. Sattellite Township, P.S. New Jalpaiguri, District-Jalpaiguri, at the instance of the private respondent.

It is the case of the petitioner that he is the owner of apartment No.B-12 situated adjacent to the said premises. It is alleged that the private respondent, being the immediate neighbour of the petitioner, has undertaken unauthorised construction at the premises, causing serious inconvenience to the petitioner. Despite the petitioner having submitted multiple representations, including the representation dated 19.05.2025, before the concerned authority, no effective steps have been taken by the respondent authorities till date.

The continued inaction has compelled the petitioner to seek appropriate relief from this Hon'ble Court.

Learned Counsel for the respondent submits that this matter appears to be a private dispute between the parties. Nevertheless, he submits that the authorities are ready and willing to consider petitioner's representation dated 19.05.2025.

Learned Counsel for the petitioner submits he shall be satisfied if the same is decided within a time bound manner.

In view of above, the present writ petition is disposed of with a direction to the respondent

to consider and decide the petitioner's representation dated 19.05.2025 within a period of eight weeks from the date of communication of this order after affording a personal hearing to the petitioner as well as the private respondent by way of a speaking order.

With the above direction, the present writ petition is disposed of.
