Learned advocate appearing for the petitioners submits that the present case being Kotwali Police Station Case No. 508 of 2007 dated 08.09.2007 has been pending for about 18 years and the petitioners have been attending the court. It has further been submitted that only two witnesses have been examined out of seven witnesses so cited by the prosecution. Although the petitioners prayed for quashing of the proceedings, but have restricted the submission before this Court for expediting the progress of the trial. In view of the limited submissions and prayers so advanced, learned advocate appearing for the petitioners is directed to serve copy of this revisional application upon Mr. Nilay Chakraborty, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

In view of the proceedings pending for about 18 years, I direct the learned Judicial Magistrate, 1st Court, Jalpaiguri to fix at least one date in each and every month. Learned trial

court would prepone the date so fixed in the month of January, 2026 and fix a schedule having considered the period of anxiety and agony faced by the petitioners for the systematic delay which has already occasioned. Learned Magistrate would prepone and fix the next date in the month of August, 2025 and ensure that the judgement of the case is delivered at least after providing adequate opportunity to each and every witness cited by the prosecution on or before 31st December, 2026. With the aforesaid observations, the revisional application being CRR 252 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
