1. Affidavit of service is taken on record.

2. The petitioner is an Assistant Teacher of Banyar Par Primary School, Cooch Behar. The petitioner wants to resign from his current position and accordingly the petitioner submitted a resignation letter. The resignation letter was not considered by the Chairman, Cooch Behar District Primary School Council, as some overdue amounts were payable by the petitioner.

3. The petitioner submits that maximum amount has been paid and the petitioner is willing to pay the remaining amount, but the Council is not cooperating.

4. Mr. Dhar denies such allegation and submits that the Council will accept the resignation letter as soon as the remaining amount of Rs.76,982/- is paid by the petitioner towards full and final settlement of the amount overdrawn by him.

5. The petitioner shall refund the said amount, as mentioned by Mr. Dhar, within a period of ten days and his resignation letter will be accepted within a week thereafter.

6. The writ petition is accordingly disposed of.

7. There shall be no order as to costs.

8. Parties are directed to act on the basis of the server copy of this order.
