W. P. No. 24115 (W) of 2019 Mitali Barman (Ray) & Ors.

-vsState of west Bengal & Ors.

Ms. Papiya Chattopadhyay for the petitioners Mr. Jaharlal De, Mrs. Smita Das De for the State Pursuant to the order passed by this court on 7th January 2020, deficit court fees have been paid by the learned counsel for the petitioners vide Receipt No. A-743 dated 10.01.2020.

In response to a Recruitment Notice published on 8th July 2010 for recruitment to the post of Anganwadi Workers in different Anganwadi Centers of the respective Gram Panchayet under the Dinhata-I Block the petitioners applied for being appointed in the said post. The recruitment process was held up temporarily due to filing of writ petition followed by appeal which was pending disposal before this court.

The contention of the petitioners is that the panel which was prepared for giving appointment in terms of the said advertisement has been revived presently and appointments are given from the said panel. The petitioners have been intimated that their names are appearing in the panel and the petitioners will be given appointment as and when the panel will be approved.

The petitioners through their learned advocate filed a representation demanding justice from the respondent authorities highlighting their grievances. The said representation was received by the respondent authorities on diverse dates in the month of December 2019. The petitioners pray for a direction upon the respondent authorities to consider the said representation made on their behalf.

The learned advocate representing the State respondent submits that in terms of the order passed by the Hon'ble Division Bench on 31st January 2018 in FMA No. 525 of 2015 steps have been taken for approval of the merit list that was prepared in terms of the Recruitment Notice dated 2010. In view of the aforesaid submissions, I am of the opinion that no useful purpose will be served by keeping the writ petition pending. Accordingly, this writ petition is disposed of by directing the respondent No. 7 being the Child Development Project Officer, Dinhata-I ICDS Project and the respondent No.

9 being the Block Development Officer, Dinhata-I Block to take necessary steps for approval of the merit list which was prepared pursuant to the Recruitment Notice dated 8th July 2010 at the earliest but positively within a period of eight weeks from the date of receipt of a copy of this order. In the event, the names of the petitioners are appearing in the said approved merit list, necessary consequential steps shall be taken by the concerned respondents for issuance of appointment letter in their favour. W.P. No. 24115 (W) of 2019 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
