Petitioner(s) Mr. Pratap Khati ... for the petitioner(s) Mr. Abhijit Sarkar Mr. Dhiman Shil ... for the State-respondent(s) The petitioner claims that he is innocent of the charges and has been implicated as an absconding accused in the charge-sheet submitted in connection with Bhaktinagar P.S. Case No. 502 of 2023 dated 19.06.2023. Although, the revisional application has been preferred for quashing of the proceeding, but, as the charge-sheet has been submitted and none of the documents under Section 207 of the Cr.P.C. has been enclosed along with the revisional application, I am of the view that the prayer so advanced for quashing of the proceeding cannot be considered by this Court at this stage. Learned advocate for the petitioner submits that warrant of arrest has been issued against the petitioner.

As none appears on behalf of the State, Mr. Abhijit Sarkar, learned advocate, who ordinarily appears on behalf of the State is directed to represent the State. Mr. Sarkar is entitled to have a junior of his choice. The appointment of both Mr. Sarkar and the junior of his choice, if any, be regularized by the concerned authority.

Let a copy of the revisional application be served upon the learned advocate for the State.

The warrant of arrest so issued against the petitioner be stayed for a period of four weeks. In the meantime, if the petitioner surrenders and prays for bail, the learned Magistrate would consider the application for bail of the petitioner in accordance with law.

With the aforesaid observations, CRR 255 of 2025 is disposed of.
