No. 1509 of 2024 arising out of Pundibari Police Station Case No. 618 of 2024 dated 11.08.2024 under sections 126(2), 118(2) and 109 of the Bharatiya Nyay Sanhita.

Petitioner is directed to serve a copy of the revisional application upon Mr. Nilay Chakraborty, learned advocate who ordinarily appears on behalf of the State. His appearance may be regularized by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner was blessed with an order of

anticipatory bail on 14.11.2024 vide CRM (A) 774 of 2024. However, he could not organize local sureties and consequently, after submission of charge sheet warrant of arrest has been issued against him.

In view of the petitioner having not appeared before the Court and for reasons which were beyond his control, I direct that in case the petitioner appears before the learned CJM, Coochbehar on or before 11.07.2025 on the same terms and conditions as imposed in CRM (A) 774 of 2024 the learned Court would release the petitioner on bail. The learned CJM, Coochbehar may impose additional conditions if he is of the opinion that the appearance of the petitioner may be ensured by imposing some other stringent conditions.

With the aforesaid observations CRR 256 of 2025 is disposed of.
