03.01.2020 ss Rejected C.R.M. 12495 of 2019 In the matter of : An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed on 24.12.2019 in connection with Rajganj P.S. Case No. 366 of 2019 dated 07.11.2019 under sections 498A/306 of the Indian Penal Code.
And In the matter of : Dipali Roy & Anr.
Mr. Pravas Bhattacharya ... ... for the petitioners Mr. Arijit Ganguly Mr. Avik Ghatak ... ... for the State It is submitted on behalf of the petitioners that they are the in-laws of the victim housewife and have been falsely implicated in the instant case.
Learned lawyer for the State opposes the prayer for anticipatory bail and submits that the petitioners had subjected the housewife to torture compelling her to commit suicide.
We have considered the materials on record prima facie disclosing involvement of the petitioners in torturing the victim housewife who committed suicide within five years of marriage leaving behind two minor children. Under such circumstances, we are of the opinion this is not a fit case to grant anticipatory bail to the petitioners.
This application for anticipatory bail is, thus, rejected. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
