APP Mr. Sourav Ganguly ... for the State Learned advocate for the petitioners submits that the petitioners are in custody since 28th March, 2025 when they were arrested by the investigating agency of the Pundibari Police Station.

According to the learned advocate allegedly recovery was just above the commercial quantity and since a substantial time has passed, the petitioners should be released on bail.

Learned advocate for the State submits that the investigation of the case is still in progress.

Having considered that the recovery from the petitioners allegedly is over commercial quantity of the contraband, at this stage, I am not inclined to release the petitioners on bail.

Accordingly the prayer for bail of the petitioners is Rejected.

However, the petitioners would be at liberty to approach this court after the charge-sheet is submitted by the investigating agency.

Accordingly, CRM (NDPS) 234 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
