IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri C.R.M. (NDPS) 236 of 2025 With CRAN 1 of 2025 In Re : An application for relaxation and modification of the bail application.

And In Re :

Nicholas Tamang Adv. Chanda Jha ... for the petitioner.

Adv. Abhijit Sarkar Adv. Arjun Chowdhury ... for the State.

The petitioner was granted bail by this Court on 13th June, 2025 subject to furnishing bond to the satisfaction of the learned Special Court, NDPS Act, Siliguri, with a further direction that one of the sureties should be local surety possessing title deed of a property within the district of Darjeeling.

Learned counsel for the petitioner submits that the father of the petitioner is a day labourer and the petitioner's case is being financially supported by several NGOs. For the said reason, the petitioner is unable to furnish local surety. Upon consideration of the submission made on behalf of the parties, the bail condition imposed upon the petitioner is modified to the extent that instead of the local surety, the petitioner shall furnish bond comprising two registered

sureties. The other conditions of bail imposed upon the petitioner shall remain unaltered.

CRAN 1 of 2025 is disposed of.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
