Learned advocate appearing for the petitioner submits that the petitioner was arrested on 17.11.2024 and in spite of charge having been framed in connection with the instant case no witness has been examined till date.

Learned advocate submits that there is no possibility of the trial being completed in near future, as such the petitioner should be released on bail.

Learned advocate appearing for the State submits that there are other similar cases against the petitioner and the petitioner happens to be a history-sheeter. However, having considered the plight expressed by the learned advocate for the petitioner the seizure in the present case according to the State is of commercial quantity and as such the rigors of Section 37 of the NDPS Act is attracted.

However, having considered the progress of the case, I direct that the petitioner would be at liberty to renew his prayer for bail after the evidence of CSW 1, 2 and 3 is over.

At this stage, the prayer for bail being CRM (NDPS) 238 of 2025 is dismissed.
