However, respondent nos. 4 and 5 remain unrepresented. Affidavit-of-service affirmed today be taken on record.

The grievance of the petitioner is petitioner purchased a plot of land which is described in the letter of the learned advocate of the petitioner dated 13th April, 2023 which is at page 21 of the writ petition and after execution of conveyance deed petitioner has been informed that perhaps the land in question which has been purchased by the petitioner has been acquired by the concerned authority of the State-respondents. In order to know the status of the land in question and whether the said land has been acquired or not the said letter dated 13th April, 2023 was submitted before the

Special Land Acquisition Officer, Jalpaiguri being respondent no. 3. In receipt of such letter vide memo dated 29th May, 2023 the respondent no. 3 informed the petitioner that petitioner is required to submit an application under the Right to Information Act, 2005.

Petitioner seeks information from the respondent no. 3 whether the land in question has been acquired or not.

Having considered the submissions made on behalf of the petitioner and the State-respondents it appears that innocuous prayer has been made by the petitioner to the extent of providing information whether the land described in page 21 of the writ petition has been acquired by the State-respondents or not.

In view of these facts this Court directs Special Land Acquisition Officer, Jalpaiguri being respondent no. 3 to provide information to the petitioner whether the said land has been acquired or not within a period of 4 (four) weeks from the date of communication of this order.

Petitioner is directed to supply another copy of the letter dated 13th April, 2023 to the respondent no. 3 at the time of communication of the order passed by this Court.

With the aforesaid directions, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
