Kausik Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (NDPS) 241 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NDPS Case No. 08/2025 arising out Sitai Police Station Case No. 05/2025 dated 04.01.2025 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been intercepted as he was innocent and the others fled away. As such, in spite of charge sheet having been submitted there has been no progress of the case. Learned advocate for the State submits that 100 bottles of Phensedyl cough syrup were recovered from the joint possession of the petitioner and others.

Having considered the same, I am of the view that the petitioner at this stage has been unable to overcome the rigours of Section 37 of the NDPS Act.

Thus, CRM (NDPS) 241 of 2025 is dismissed.
