Kausik Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (NDPS) 243 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sitai Police Station Case No. 73 of 2025 dated 02.04.2025 under Section 21(c)/20(b)(ii)(B)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case for alleged recovery of some contraband.

Learned advocate for the State submits that 160 bottles of phensedyl cough syrup along with 9.5 Kgs of Ganja were recovered allegedly from the possession of the petitioner and others.

I find that the investigation of the case is still in progress as the same has commenced on 02.04.2025.

Having considered the stage of the case, I am not inclined to consider the prayer for bail.

At this stage, consequently CRM (NDPS) 243 of 2025 is dismissed.

Petitioner would be at liberty to approach this Court after the submission of charge sheet before the jurisdictional Special Court.
