Court No.2.

Kausik Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (M) 118 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Siliguri Women PS Case No. 85 of 2024 dated 30.07.2024 under Section of POCSO Act read with Section 417/313/325/420/506/34 of the Indian Penal Code. And In the matter of : Md. Nasir @ Sahil ......Petitioner.

Mr. Arunava Paul ......for the Petitioner.

Ms. Suparna Paul .....for the opposite party no. 2 (defacto complainant) Mr. Kallol Acharjee Mr. Sagnik Sankar Sikdar ....for the State.

Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in the instant case. Learned advocate for the State as well as the private opposite party no. 2 is present and points out that on 14.05.2025 the prayer for bail of the petitioner was dismissed by the Co-ordinate Bench.

Having considered that very recently the application for bail of the petitioner has been rejected by the High Court and there has been no change of circumstances, at this stage, I am not inclined to accept the prayers advanced by the petitioner.

Accordingly, CRM (M) 118 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
