Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of a co-accused and no incriminating materials has been seized by the police authorities from the petitioner, as such, the petitioner may be released on anticipatory bail.

Learned advocate appearing for the State on the other hand submits that 98 bottles of 'BLUREX-T' cough syrup were recovered from one Mrinal @ Kunal Roy and the said accused subsequently named the present petitioner.

Be that as it may, since the Case Diary do not contain any other materials except the statement of the co-accused, I am of the view that custodial interrogation of the petitioner is unwarranted, as such the prayer for anticipatory bail is allowed.

Accordingly, I direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

If on bail the petitioner shall meet with the investigating officer once in a week till further orders being modified by the learned Special Court.

Accordingly CRM (A) 370 of 2025 is allowed.
