Heard learned counsels for the parties.
Learned counsel for the petitioners submits that the petitioners are innocent villagers from whom no narcotic substance was recovered. The only allegation against them is that they obstructed the police personnel in apprehending the principal accused.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The petitioners appear to be villagers who apparently obstructed the police personnel in apprehending persons from whom narcotic substance was recovered. The injury
report demonstrates that the petitioners did not participate in the assault of the police personnel.
Considering the material on record, this Court is inclined to grant anticipatory bail to the petitioners. Accordingly in the event of arrest, the petitioners namely Parvina Khatun, Mamata Bibi, Hachina Bibi and Aspa Bibi be released on bail upon furnishing bond of Rs.10,000/-(Rupees Ten Thousand) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.
The application for anticipatory bail is thus disposed of.
