Petitioner approached this Court as there was noncompliance on behalf of the State so far as the order dated 02.05.2025 was passed by Special Court being the learned Additional Sessions Judge, 1st Court (NDPS), Cooch Behar in connection with NCBR GRPS Case No. 01/2025 dated 13.01.2025. Having considered that the main grievance of the petitioner was that the State was reluctant to hand over the materials which were part and parcel of the direction dated 02.05.2025, this Court was approached.
Mr. Chakraborty, learned APP appearing for the State submits that a report has been prepared by the SubInspector of Police attached to New Cooch Behar GRPS. The same encloses the contents regarding the Parking Area of New Cooch Behar Railway Station, Platform Nos. 1 and 3 of New Cooch Behar Railway Station and Foot Over Bridge of New Cooch Behar Railway Station on 12.01.2025 in respect of different timings and duration.
A copy of the said report be handed over to the learned advocate appearing for the petitioner.
The CCTV footage which has been collected by the concerned S.I. of Police be immediately handed over to the learned Special Court under the NDPS Act at Cooch Behar in seisin of the case.
If the petitioner intends to have inspection of the contents of the CCTV footage, appropriate application be advanced before the learned Trial Court/Special Court. Learned Trial Court would provide opportunity of inspection of the contents of the same to the learned advocates for the petitioner.
With the aforesaid observations, the revisional application being CRR 268 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.
Report so submitted on behalf of the State be kept with the record.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
