....For the State The application for anticipatory bail is canvassed on the ground that the principal accused has been granted bail by the Court below.
The petitioner apprehends arrest in a case which according to the petitioner has no basis.
It is submitted that there is no independent evidence to suggest involvement of the petitioner against the death of his sister-in-law.
Counsel for the State opposes the prayer for anticipatory bail and submits that the petitioner is absconding and searches are continuing on the part of the police.
Having carefully considered the materials in the case diary and in view of the fact that the petitioner is absconding till date, this Court finds substantial allegations against the petitioner in the case diary. It, therefore, cannot be said that there are no materials against the petitioner.
In such circumstances, the prayer for anticipatory bail of the petitioner is rejected at this stage. The Case Diary be returned.
