Learned advocate appearing for the petitioner is directed to serve a copy of the revisional application upon Mr. Abhijit Sarkar, learned advocate who ordinarily appear on behalf of the State, his appointment may be regularized by the concerned authorities.
Learned advocate for the petitioner submits that petitioner could not appear before the learned Special Court because of miscommunication and consequently warrant, proclamation and attachment was issued against him. Petitioner apprehends that he may be taken into custody, in case he surrenders and appear before the Court.
Having considered that the petitioner was earlier granted bail and subsequently did not appear and is ready and willing to appear before the learned Special Court, I direct that the warrant, proclamation and attachment so issued be kept in
abeyance till 18th of July, 2025. In case the petitioner appears within the aforesaid period, petitioner may be released on bail subject to furnishing bond by the way of local surety which must be the title deed of the property within the jurisdiction of the district of Jalpaiguri.
In case the petitioner fails to appear within the aforesaid period, the learned Special Court would exhaust harsher process of law for compelling the appearance of the petitioner. With the aforesaid observations CRR 271 of 2025 is disposed of.
