Learned advocate appearing for the petitioners submits that the petitioner no.1 is the father-in-law and the petitioner no.2 is the brother-in-law and they have been implicated in connection with the instant case as the wife of the other son has committed suicide. Petitioners claimed that they are innocent of the charges and they have been made accused because of the untimely death of the victim. However, the main allegations according to the petitioners are against the husband of the deceased.

Learned advocate appearing for the State has produced the Case Diary.

I have considered the materials and also the fact that the husband namely, Sujit Sarkar has been taken into custody. Having considered the same, I am of the view that the custodial interrogation of the petitioners may not be warranted in the facts and circumstances of the case. Accordingly, the prayer of anticipatory bail is allowed.

As such, I direct that in the event of arrest, the petitioners be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty thousand only) each, with two sureties of like amount each, one of whom must be local to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. If on bail the petitioners shall make themselves available to the investigating officer of the case as and when they are called.

Accordingly CRM (A) 383 of 2025 is allowed.
