APPELLATE SIDE C.R.M. (A) 334 of 2022 In Re:- An application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973, filed on 07.07.2022 in connection with Mathabhanga Police Station Case No. 03 of 2022, dated 02.01.2022 under Sections 498A/304B of the Indian Penal Code.

And In the matter of : Ranjan Biswas & Anr.

...petitioners Mr. Subhasish Misra ...For the petitioners Mr. Ujjwal Luksom, Mr. Tapan Bhattacharjee .......For the State An application for anticipatory bail is sought on the ground that four co-accused persons have already been enlarged on bail. It is also argued that on the date of incident, the petitioner no. 1, husband was out of Station. A railway ticket is produced to that effect.

This Court notices that the FIR was registered under Sections 498A/302 of the Indian Penal Code. The victim suffered and died after severe burn injuries. It is also stated that the petitioner has not surrendered till now, although charge sheet has been filed.

Having considered the entire charge sheet and the medical report, this Court is not inclined to entertain the application for anticipatory bail.

Hence, C.R.M. (A) 334 of 2022, shall stand rejected at this stage.
