(A) No. 335 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 filed on 07.07.2022 in connection with Sitalkuchi Police Station Case No. 122 of 2017 dated 13.05.2017 under Sections 363/365 of the Indian Penal Code and adding Section 376 of the Indian Penal Code.

...For the petitioner Mr. Kallol Acharjee, Mr. Tapan Bhattacharjee. ....For the State The application for anticipatory bail is canvassed on the ground that the petitioner only facilitated the victim to travel to Bihar to meet her lover Zahidul Miya. It is also submitted that the victim had got married to a third person since after the incident.

Counsel for the State opposes the prayer for anticipatory bail.

It appears from the record that there are suggestions and indications of trafficking and kidnapping. Having considered the materials in the case diary and considering the submissions of the Counsel for the State and the petitioner, this Court is not inclined to entertain the anticipatory bail of the petitioner at this stage.
