Learned counsel appearing on behalf of the petitioner submits that during pendency of the writ petition PPO has been issued and the family pension has also been started to be paid. However, the NFP was given effect from 12th January, 2019 instead of 29th January, 2012 which is the date on which the mother of the petitioner had passed away.

Learned counsel appearing on behalf of the State submits that the PPO has already been issued and the family pension has been started to be paid to the petitioner. If there is any genuine error in the PPO, the petitioner shall be at liberty to make an appropriate representation before the concerned authorities, which shall be considered in accordance with law.

In view of the fact that PPO has been issued and the family pension started to be paid to the petitioner, no further order need be passed in this regard.

However, in view of the further grievance of the petitioner that NFP has been given effect to from a subsequent date, the petitioner shall be at liberty to make a representation in this regard to the concerned authority within a fortnight from this date. The representation shall be answered by the State authority within four weeks from the date of receipt of such communication. The result of such consideration shall also be communicated to the petitioner within a week thereafter.

With these observations, the writ petition is disposed of.
