Mr. Deborshi Dhar, learned advocate appearing on behalf of the petitioner submits that the application has become infructuous.
The present revisional application has been filed challenging the order No. 2 dated 22.6.2022 passed by the learned Additional Sessions Judge, Mathabhanga, Cooch Behar in Criminal revision Case No 03 of 2022 staying the order dated 21.4.2022 passed by the learned Sub-Divisional Executive Magistrate, Mathabhanga under Section 144 of the Code of Criminal Procedure in Misc. Case No. 35 of 2022. Section 144 Sub-clause 4 of the Code of Criminal Procedure provides that no order under the section shall remain in force for more than two months from making thereof. As the aforesaid period of two months has already been elapsed, the present revisional application has become infructuous.
Accordingly, the present revisional application stands dismissed.
All connected applications stand disposed of. Interim order, if any, stands vacated.
Urgent photostat certified copy of this order, if applied for, be supplied expeditiously after complying with all necessary legal formalities.
