Learned advocate appearing for the petitioner submits that the petitioner was arraigned in connection with the instant case as there were seizures to the tune of 264 grams of brown sugar. The contention of the petitioner is that there is every possibility of the same being over-weight because of the weight of the plastic packets. Learned advocate placed the orders of CRM 3570 of 2021 to substantiate his contention. Learned advocate appearing for the State opposes the prayer of bail submits that commercial quantity of contraband was seized in connection with the instant case from the possession of the petitioner.

Having regard to the fact that the case which has been relied upon by the petitioner was marginally overweight, while in the present case 14 grams excess brown sugar are there above commercial quantity, I am not inclined to accept such prayer.

Learned advocate for the State has also submitted that the CFSL Report has been collected.

Having regard to the same, at this belated stage, I am not inclined to accede to the prayer of the petitioner. Accordingly, CRM (NDPS) 253 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
