Netra Bahadur Bhujel Mr. Arnab Saha ... for the petitioner.

Md. Shoiab Akhter ... for the defacto complainant Mr. Abhijit Sarkar Ms. Sukanyha Adhikary ... for the State.

Supplementary affidavit submitted by the defacto complainant indicates that marriage was solemnized between the defacto complainant and the brother of the petitioner.

Heard learned counsels for the parties.

Prayer for anticipatory bail was turned down earlier. The petitioner renews his prayer on account of change in circumstance.

I have perused the material on record. The petitioner is the brother of the principal accused who has subsequently married the defacto complainant.

Considering the change in circumstance of the case, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly in the event of arrest, the petitioner namely Netra Bahadur Bhujel be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand), with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is thus disposed of.
