Heard learned counsel for the parties. In absence of any supervening circumstances, we are not inclined to exercise our discretion under Section 439 of the Cr.P.C in favour of the petitioner. However, as there was a direction of Their Lordships Hon'ble Justice Harish Tandon and Hon'ble Justice Biswaroop Chowdhury on 1st August, 2023 to conclude the trial within eight months from 1st August, 2023, we request the trial court to make endeavour to conclude the trial within a period of one year from date. Defence is also requested to cooperate with the trial and not to take unnecessary adjournments.

With the above observation, CRM (NDPS) 253 of 2024 is dismissed.
