Learned advocate appearing for the petitioner submits that the petitioner has been implicated in this case by way of an afterthought and she happens to be the mother-in-law of the deceased. Additionally, it has been submitted that bare perusal of the FIR would reflect that there were no demand of dowry at the time of marriage, but after the death of the daughter of the complainant, an accusation has been made for demand of Rs.1,00,000/-. It has also been pointed out that already father-in-law and the husband are in custody.

Learned advocate appearing for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the statements of the relevant witnesses which emphasize on the complicity of the present petitioner. However, having considered that the present petitioner is a lady and the accusations against her, if any, are too general for her detention in custody in course of investigation. As such, the prayer for anticipatory bail of the petitioner is allowed.

Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

The petitioner shall make herself available as and when called for by the Investigating Officer of the case and shall not leave the district of Jalpaiguri without the leave of the learned Chief Judicial Magistrate, Jalpaiguri.

The application for anticipatory bail, being CRM(A) 403 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
