IN THE CIRCUIT BENCH AT JALPAIGURI
APPELLATE SIDE C.R.M. (A) No. 344 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 filed on 08.07.2022 in connection with Mathabhanga Police Station Case No. 4 of 2022 dated 03.01.2022 under Sections 14(A)/14(C) of the Foreigners' Act.
And In the matter of: Amit Barman & Anr.
...petitioners Ms. Suman Sehanabis (Mandal), Mr. Alok Sah.
...For the petitioners Mr. Aditi Sankar Chakraborty, Mr. Biswarup Roy.
....For the State Application for anticipatory bail is filed on the ground that the petitioners are the Indian Nationals and have been falsely implicated under the Foreigners' Act. It is submitted by the Counsel for the petitioners that his clients are the local villagers residing at the border. Counsel for the State opposes the prayer for anticipatory bail.
Having considered the materials in the case diary and bearing in mind the submissions made on behalf of the State, this Court finds that the petitioners are alleged to have harboured Foreign Nationals involved in cattle smuggling.
In view of the facts as aforesaid, the prayer for anticipatory bail of the petitioner cannot be considered at this stage and hence the same is rejected.
The Case Diary be returned.
C.R.M. (A) No. 344 of 2022 is, thus, dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Ananda Kumar Mukherjee, J.) (Rajasekhar Mantha, J.)
