(A) No. 345 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 filed on 08.07.2022 in connection with Sitai Police Station Case No. 192 of 2021 dated 29.11.2021 under Sections 399/402 of the Indian Penal Code and Sections 4/5 of the Explosive Substances Act, 1908.

And In the matter of: Arun Barman @ Hola & Ors. ...petitioners Ms. Suman Sehanabis (Mandal), Mr. Alok Sah.

...For the petitioners Mr. Aditi Sankar Chakraborty, Mr. Aniruddha Biswas. ....For the State Anticipatory bail is sought on the ground that the petitioners were only found loitering around the place where the explosive articles were seized.

It is submitted by the Counsel for the petitioners that his clients have no role to play in the offence alleged against them.

Counsel for the State opposes the prayer for anticipatory bail.

It appears from the record that the State has found the petitioners and the other co-accused persons were planning to rob the Khetriya Gramin Bank.

Having considered the materials in the case diary and considering the articles seized in the seizure list, this

Court is of the view that the prayer for anticipatory bail of the petitioners cannot be entertained at this stage. The Case Diary be returned.
