Learned advocate appearing for the petitioners prays for anticipatory bail in respect of Manabendra Nath Roy @ Manu Roy, Biplab Roy @ Bipul Roy and Tushar Roy @ Tushar Kanti Roy. It has been contended on behalf of the petitioners that they are innocent and they have been falsely implicated in connection with the instant case and it is the injured who had acted in a manner which compelled the people of the locality to resist his conduct. Learned advocate for the petitioners submits that the petitioners would abide by any stringent condition imposed by the Court.
Learned advocate appearing for the State has produced the case diary and drawn the attention of the Court to the injury report as well as the statement of the injured.
Having considered that the complicity of the present petitioners and their overt acts are reflected in the statement of the injured, I am of the opinion that this is not a fit case for granting anticipatory bail. As such, the prayer for anticipatory bail of the petitioners is rejected. The application for anticipatory bail, being CRM(A) 406 of 2025, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
