Learned counsel appearing for the petitioner prays for expeditious hearing of a suit for specific performance of contract, injunction and consequential relief, instituted by the petitioner before the Civil Judge (Senior Division) at Jalpaiguri.
Despite service, none appears on behalf of the opposite party. However, in view of the innocuous nature of the prayer, fresh service of notice on the opposite party is not deemed necessary.
In view of the above, C.O. No. 86 of 2022 is disposed of by requesting the Civil Judge (Senior Division) at Jalpaiguri to dispose of Title Suit No. 46 of 2013 pending before the said court, which is already at the peremptory hearing stage, along with all interlocutory applications, if pending in connection with the suit, as expeditiously as possible, preferably
within six months from the date of communication of this order to the said court. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be made available to the parties, upon compliance of all requisite formalities.
