Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Mr. Kallol Acharjee, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

The present revisional application has been preferred in respect of Kurseong Police Station Case No. 235 of 2016 dated 30.11.2016 wherein charge-sheet was submitted in the year 2017. The present stage of the case is that charge has already been framed and the evidence of one of the witnesses has already started. A perusal of the revisional application reflects that none of the document under Section 207 of the Code of Criminal Procedure on which the prosecution relied upon to establish its case has been enclosed along with this revisional application.

Having considered that the belated stage at which the petitioner approached this Court, I am of the view that the same cannot be entertained at this stage. No interference is made by this Court at this stage.

The petitioner would be at liberty to canvass the issues in course of cross-examination and at the stage of final argument of the case.

The learned trial court henceforth is directed to fix a schedule of two dates and fix such schedule once in a month so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 153 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
