...for the State Learned advocate appearing for the petitioner has approached this Court as on the earlier occasion the learned lawyer representing the petitioner declined to cross-examine the victim and subsequently a new lawyer was engaged. The new lawyer so engaged prayed for time on the grounds that he has not received the documents. Learned advocate appearing for the petitioner submits that the revisional application was preferred, however, the petitioner intends to prefer an application under Section 311 of the Code of Criminal Procedure. Petitioner is directed to handover a copy of the revisional application upon Mr. Tapan Bhattacharjee, learned advocate who ordinarily appears on behalf of the State, his appearance may be regularized by the concerned authorities.

Be that as it may, if so advised the petitioner would be at liberty to file the same, learned Special Court would consider the same in accordance with law.

With the aforesaid observations CRR 286 of 2025 is disposed of.
