The instant contempt application was filed alleging violation of the direction passed by the Court on February 27, 2020.

Today when the matter has been taken up for consideration a communication dated January 13, 2022 being Memo No. LA/33 by the Special Land Acquisition Officer, Cooch Behar has been handed over in Court by the learned advocate representing the alleged contemnor.

It appears therefrom that the direction passed by the Court to intimate the petitioner as to whether his

land has been acquired for the purpose of setting up of the pump or not has been communicated to the petitioner by the aforesaid communicating memo. In view of the above, there is no requirement for proceeding with the contempt application any further. It will be open for the petitioner to assail the communication, if so advised.

Copy of the Memo No. LA/33 dated January 13, 2022 issued by the Special Land Acquisition Officer, Cooch Behar be retained with the records.

The contempt application stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
