IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri C.R.M. (M) 150 of 2025 In Re : An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Siliguri Women Case No. 17 of 2024 dated 21.02.2024 under Sections 6 of the POCSO Act.

And In Re :

Md. Anwar @ Guddu Adv. Seema Agarwal Adv. Faiz Ahmed ... for the petitioner.

Adv. Aditi Shankar Chakraborty, Ld. APP Adv. Sagnik Sarkar Sikdar .. for the State.

Affidavit of service filed by the petitioner is taken on record.

The victim is not represented despite service. Heard learned counsels for the parties.

Prayer for bail was turned down by this Court on 7th December, 2024.

Learned counsel for the petitioner submits that there is no progress in trial after the said rejection. Learned counsel for the State opposes the prayer for bail and submits that nine witnesses are remaining to be examined.

The petitioner is in custody for more than a year. He has not been implicated by the witnesses in trial.

Considering the material available on record as well as prima facie involvement of the petitioner in the alleged offence, the prayer for bail is rejected. However, the trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application for bail is, thus, disposed of. Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
