The writ petition was filed on the allegation that the police failed to take any step in response to the complaint lodged by the petitioner alleging fraud.

After the writ petition was filed, the police have registered FIR being Pundibari P.S. Case No. 464/2024 dated 25.06.2024 under Sections 420/468/120B I.P.C. The petitioner prays for a direction for providing police protection at the time of construction of the boundary wall.

The Court is of the opinion that it will not be appropriate to direct the police to provide protection at

the time of construction of the boundary wall as sought for. The police will, however, ensure that there is no breach of peace at the locale.

As regards the grievance of the petitioner that the record of rights has been changed in a fraudulent manner, it will be open for the petitioner to approach the competent forum for relief.

It goes without saying that the record of rights is not the document either in support of ownership or title of a property and ownership and title necessarily flows from the title deeds.

The report filed by the Officer-in-Charge, Pundibari Police Station, Cooch Behar signed on 26th June, 2024 is taken on record.

The writ petition stands disposed of.
