Circuit Bench at Jalpaiguri C.R.M. (A) 414 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NJP Police Station Case No.

125/25 dated 01.03.2025 under Sections 126(2)/117(2)/118(2)/109/304(2)/3(5) with added Section 103(1) of BNS.

Kanika Roy @ Laxmi Roy Ms. Seema Agarwal Faij Ahmed ... for the petitioner.

Mr. Aditi Shankar Chakraborty Mr. Subhasish Misra ... for the State.

Heard learned counsels for the parties.

Though this is a case of brutal murder, the petitioner has not been named by the witnesses in their statement recorded under Sections 161/164 of the Code of Criminal Procedure. The offending weapons have not been recovered from the possession of the petitioner. Presence of the petitioner at the place of occurrence at the relevant time has to be assessed at the appropriate stage of trial. Considering the material available before me, this Court is of the view that the petitioner may be granted anticipatory bail.

Accordingly in the event of arrest, the petitioner namely Kanika Roy @ Laxmi Roy be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand), with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is thus disposed of.
