12.08.2025 SL. 18 Court No. 3 Sourav In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Revisional Jurisdiction C.R.R. 211 of 2024 In re: An application Under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

And In the matter of: Arati Mishra & Ors.

... petitioners.

Mr. Kallol Acharjee Mr. Dhiman Sil ... for the State.

1.

This is application under Section 482 Cr.P.C. seeking quashing of entire proceeding in connection with NJP P.S. Case No. 1163 of 2023 dated 29.12.2023 under sections 498A/34 IPC read with Sections 3 and 4 of Dowry Prohibition Act in which charge-sheet has been submitted under the aforementioned sections against the accused petitioners.

2.

None appears on behalf of the petitioners at the time of call, however, Mr. Acharjee, learned Public Prosecutor-in-charge is present.

3.

In course of his submission, Mr. Acharjee submits that from the materials available in the case diary, it reveals that a prima facie case has been made out as against the present accused petitioners to go for trial for facing charges under Sections 498A/34 IPC read with Sections 3 and 4 of D.P. Act.

4.

This Court has meticulously perused the entire materials as available in the C.D. It appears to this Court that even if, those materials have taken for consideration at their face value no case has been made out on behalf of the accused petitioners for not constituting an offence as claimed. 5.

On the contrary, as rightly argued by Mr. Acharjee that there are prima facie sufficient incriminating materials as against the present accused petitioners to go for trial in connection with the offences under which charge-sheet has been submitted.

6.

With the aforementioned finding, the instant petition being CRR 211 of 2024 is dismissed.

7.

Interim order, if therebe any, stands hereby vacated. 8.

With the dismissal of the instant revisional application, all pending interlocutory applications, if therebe any, are also dismissed.
