Heard learned counsels for the parties.

The petitioner seeks parity with co accused Rahul Singh who was the driver of the vehicle carrying contraband articles.

Learned counsel for the State opposes the prayer. I have considered the material on record. Co accused Rahul Singh was granted bail on the consideration that he was granted interim bail earlier and had not misused his liberty. The co accused Rahul Singh appears to be the driver of the vehicle. The petitioner was found in possession of the contraband articles and was seated beside the driver in the vehicle. He has been in custody for about 238 days. Charge sheet has been submitted.

In view of the statutory restriction under Section 37 of the NDPS Act, prayer for bail is rejected at this stage. The application for bail is thus disposed of. Case Diary be returned.
