1. This revisional application has been filed with a prayer for Ct rup giving a direction upon the learned Chief Judicial Magistrate, Jalpaiguri to release the vehicle which is lying in the premises under the Bhaktinagar Police Station without unnecessary delay.

2. Learned counsels on behalf of the parties to this revisional application have submitted that petitioner filed one application for releasing the vehicle which is still pending before the Court of learned Chief Judicial Magistrate, Jalpaiguri.

3. In these circumstances, this court has no jurisdiction to

direct the learned Chief Judicial Magistrate to release the vehicle in favour of any of particular person without hearing the parties to that application which is pending before the learned Court of Chief Judicial Magistrate, Jalpaiguri.

4. However, learned Chief Judicial Magistrate, Jalpaiguri is requested to dispose of the application with a prayer for releasing vehicle pending before it as early as possible.

5. With this observation, the revisional application stands disposed of.

6. Petitioner is at liberty to communicate this order to the learned Court of Chief Judicial Magistrate, Jalpaiguri.

7. All the parties shall act on the server copy of this order duly downloaded from the official web site of this Court.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
