Mr. Debjit Kundu ...for the petitioner Mr. Subir Kumar Saha ...for the State Affidavit of service filed by the petitioner is taken on record.

The petitioner is the widow of Bharat Thapa who was a teacher in the primary school and superannuated on January 31, 2021. He expired on June 09, 2022. Despite completing all the required formalities, there was a delay in disbursal of the gratuity due to the employee which was disbursed in favour of the petitioner on December 10, 2024. The petitioner prays for interest on the gratuity amount disbursed in his favour due to the delay in disbursal of the same.

Upon consideration of the submission made on behalf of the parties as well as the material on record, the writ petition is disposed of directing the Director of Pension, Provident Fund and Group Insurance, West Bengal and the Treasury Officer, Kalimpong, being the 2nd and 4th respondents herein, to pay interest to the

petitioner @8% per annum on the gratuity amount calculated from February 01, 2021 till the date of actual payment of the amount. Such payment shall be made within one month from the date of communication of this order.

With these observations, the writ petition is disposed of.

Since, no affidavit in opposition has been called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents. There will be no order as to costs.
