It is submitted on behalf of the respondent that pursuant to an order dated 7 July, 2025, an appropriate application for enforcement of an order dated 3 June, 2024 has been filed before the Civil Judge, Senior Division, Siliguri numbered as Money Execution Case No. 1 of 2025.

In view of the non-appearance of the appellant, FMAT/10/2024 stands dismissed for default.

CAN/1/2025 and CAN/2/2025 are also dismissed as infructuous.

It is important to mention that the matter was heard on two prior dates i.e. 30 June, 2025 and 7 July, 2025 before this Bench when the appellant was directed to take instructions.

Non-appearance of the appellant and failure to comply with the directions to take instructions as to the mode and manner of payment is deliberate and intentional. Moreover, the defects as pointed out by the department have not been cured.

In view of the above, the issue of maintainability of this appeal in the light of statutory alternative efficacious remedy is not addressed.
