Banerjee/BP) Mr. Srijib Chakraborty Mr. Sandeep Kumar Singh ... for the petitioner Mr. Bikramaditya Ghosh Mr. Momenur Rahman ... for the State Mr. Amales Roy Mr. Deborshi Dhar ..for the University The petitioner college is aggrieved by the fact that the West Bengal University of Teacher's Training, Education Planning and Administration has approved the admission for the period 2020-22 of about 61 students but has not indicated anything with regard to balance 39 students.
Counsel for the University, Mr. Roy, submits that affiliation was granted pursuant to the order of court and after due inspection. The inspection was to determine as to whether the petitioner college complied with all the requirements and rules for recognition of the college as prescribed by the University.
Only upon a provisional affiliation being granted in this regard, students were admitted and in those circumstances this court directs the West Bengal University of Teacher's Training, Education Planning and Administration to approve the admission of the balance 39 students for the session 2020-22.
The University shall also approve the admission of 89 students admitted for the session 2021-23.
The college shall not admit any further student for the session 2021-23 unless the University grants affiliation for the entire period of one year after due compliance with all the rules of the University and inspection may be conducted by the University at the college for the aforesaid purpose within a period of one month from date. It is only upon receiving the yearly affiliation for one year that the balance 19 students shall be admitted by the college. If the students are admitted after the University grants yearly affiliation, the latter shall also approve the admission of the remaining 19 students.
It is submitted by the Counsel for the University that the Higher Education Department of the State is required to open the portal for the
purpose of registration of the students in accordance with the rules.
The said Higher Education Department, being the respondent no. 1, shall make available and open the concerned portal to register the students that have been enrolled in the college and approved by the University within two weeks from the date of communication of a copy of this order. It is made clear that in future students shall not be admitted by the college unless yearly affiliation is granted in advance by the University. With the aforesaid observation this writ application stands disposed of.
