It is submitted by the learned advocate for the petitioner that the petitioner is an Indian citizen, though the case has been registered under Sections 14A/14C of the Foreigners Act. Learned counsel for the State submits that as per the forwarding report, the Investigating Agency has claimed the petitioner to be an Indian citizen.

Having heard the learned advocates for the parties and in consideration of the material on record, it transpires that the petitioner is an Indian citizen having his residence at Mekhliganj. The petitioner has relied upon Aadhar Card in support of his contention. Charge sheet has not yet been submitted. In consideration of the fact that the petitioner happens to be an Indian citizen being charged with the offence under Section 14A/14C of the Foreigners Act, let the petitioner be enlarged on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be

local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Mekhliganj, subject to condition that he shall meet the Investigating Officer once in a week until the conclusion of investigation. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to comply with any of the conditions as mentioned above without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. The application for bail is, thus, disposed of. Case Diary be returned.
