JPD-02 Ct No.01 25.07.2024 AK Calcutta High Court In The Circuit Bench at Jalpaiguri Appellate Side CRM (NDPS) 263 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Madarihat Police Station Case No. 85 of 2024 dated 22.06.2024 under Sections 17(b)/25/29 of the NDPS Act.

And In the matter of: Ratna Ali @ Ranta Ali .... petitioner Mr. Anirban Banerjee Ms. Makteswar Rahaman ... for the petitioner Mr. Aditi Shankar Chakraborty, Ld. APP Mr. Arjun Chowdhury ... for the State 1.

In the order dated July 22, 2024, as condition of grant of bail to the petitioner, we had directed that the petitioner has to furnish a bond of Rs.5000/- with two sureties of like amount each, one of whom must be local.

Learned counsel for the petitioner submits that in view of the situation of the petitioner, it is not being possible for the petitioner to obtain a local surety at Alipurduar.

Accordingly, on verbal prayer made by the petitioner through counsel, in the presence of learned Advocate for the State, we hereby modify the order dated July 22, 2024 to the effect that the petitioner, as condition of bail, shall furnish a bond of Rs.5000/-

with two sureties of like amount each to the satisfaction of the learned Sessions Judge at Alipurduar.

It is, thus, made clear that the phrase "one of whom must be local" stands deleted from the said order.

Let this order be deemed to be a part of the order dated July 22, 2024.
