Mr. Bhaskar Roy Mahashaya Mr. Sannidhya Dutta ...for the petitioner Mr. Hirak Barman Ms. Bedashruti Bose ...for the State The writ petition has been instituted, inter alia, questioning inaction on the part of the concerned police authority in taking steps based on complaint dated 29th January, 2017 with regard to preparation of sale deed which has been executed in favour of petitioner in connection with 7 decimal land described in the said complaint dated 29th January, 2017.
Today, at the time of hearing the learned advocate representing the State-respondents has submitted a report of I/C Mathabhanga P.S.
District-Coochbehar dated 4th July, 2023 wherefrom it appears that after first round of investigation made by the concerned authority of Mathabhanga Police Station one report was filed dated 31st August, 2018. However, at the time of submitting a report dated 31st August, 2018 no charge sheet was
submitted which led the petitioner to file Na Raji petition before the learned ACJM, Mathabhanga. Subsequently, on 14th November, 2019 learned ACJM, Mathabhanga passed necessary order to make further investigation. Pursuant to the said order dated 14th November, 2019 a charge sheet has been filed dated 20th June, 2023 under Sections 420/34 of IPC against four FIR named persons. In view of the aforesaid steps taken by the concerned police authorities this Court finds that the grievance made in the writ petition is redressed. Therefore, at the present stage of criminal proceeding which is pending before the appropriate Court no further order need be passed on this writ petition. Accordingly, same stands disposed of. The report filed on behalf of Mathabhanga Police Station District-Coochbehar dated 4th July, 2023 is taken on record. However, this order shall not affect the criminal proceeding pending before the Court and this Court expects that the criminal proceeding be brought to the logical conclusion within a reasonable time.
